Terms of Service

1. Acceptance and Privacy Policy

By accessing or using solcannabis.com or any related service (collectively, the "Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the Site. These Terms form the entire agreement between you and SOL of Montgomery LLC ("SOL," "we," "our," or "us") regarding your use of the Site.

2. Eligibility

Adult-use (recreational) customers must be 21 years of age or older and must present a valid, unexpired government-issued photo ID at the time of purchase or pickup. Maryland medical cannabis patients and registered caregivers may access the Site in accordance with their program registration and applicable Maryland law.

By using the Site you represent and warrant that you meet the applicable age and eligibility requirements. SOL reserves the right to refuse service to anyone who cannot verify eligibility at the time of fulfillment.

3. Maryland-Only Lawful Use

SOL is a cannabis retailer licensed under Maryland law. The Site and all products sold through it are intended solely for use within the State of Maryland by eligible individuals as permitted under Maryland and applicable local law. By using the Site you confirm that your intended use of any products is lawful under Maryland law and that you will not transport, mail, or ship cannabis products outside Maryland or into any jurisdiction where cannabis is not lawfully permitted.

4. Federal Law Notice

Cannabis remains a Schedule I controlled substance under the federal Controlled Substances Act. Maryland's authorization of adult-use cannabis does not alter federal law. As a result:

• Cannabis may not be transported across state lines, regardless of the laws of other states involved.
• Cannabis may not be mailed or shipped through the United States Postal Service or any carrier operating under federal regulation.
• Possession of cannabis on federal property — including national parks, federal buildings, airports, and military installations — remains unlawful under federal law and may result in federal prosecution.

SOL does not authorize, facilitate, or assist with any conduct that violates federal law. Nothing in these Terms or on the Site should be construed as encouraging interstate transport, mailing, shipping, or possession on federal property.

5. Educational Content — Informational Only, Not Medical Advice

Content on the Site — including The SOL Guide education pages, the SOL Mood Match℠ recommendation tool, and responses provided through the Ask Dr. Dix feature — is for general informational and educational purposes only. It does not constitute and is not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the guidance of a qualified, licensed healthcare provider before making decisions about your health or any treatment. Do not disregard professional medical advice or delay seeking it because of information you read on this Site. No provider-patient relationship is created by any interaction on or through the Site, and SOL staff are not licensed healthcare providers.

6. Online Ordering Through Dutchie

Our online menu and shopping cart are powered by Dutchie, Inc., a third-party e-commerce platform. When you browse our menu or place an order through the Site, you are interacting with Dutchie's platform and are also subject to Dutchie's Terms of Service and privacy practices.

SOL does not store or process payment card information; payment and checkout are handled by Dutchie and its payment processors. SOL is not responsible for errors, interruptions, or failures of Dutchie's platform.

7. Online Orders — Requests Subject to Confirmation

Orders placed through the Site are requests to purchase, not guaranteed sales. All orders are subject to:

• Eligibility verification: A valid government-issued photo ID confirming age and identity must be presented at pickup. The name on the ID must match the order.
• Inventory availability: Product availability is not guaranteed and may change after an order is placed.
• Pricing and taxes: Prices shown on the menu are subject to change. Applicable Maryland cannabis excise tax and any local taxes will be calculated and added at checkout.
• Discounts and promotions: Promotional offers may be limited, subject to individual eligibility, and may not be combined unless expressly stated.
• Purchase limits: Maryland law limits the quantity of cannabis products an individual may purchase in a single transaction. Orders that exceed applicable legal purchase limits will be adjusted or declined.
• Store confirmation: SOL reserves the right to confirm, modify, or decline any order before it is fulfilled. Placement of an order does not guarantee fulfillment.

8. Order Cancellation

SOL may reject, modify, or cancel any order at our discretion — including for suspected fraud, ineligibility, inventory unavailability, pricing errors, or violation of these Terms or applicable law. If an order is cancelled by SOL, you will not be charged, or any charge will be handled in accordance with our Return Policy.

9. Responsible Use

By purchasing cannabis products through SOL, you agree to:

• Use cannabis products responsibly and only in locations where consumption is lawful under Maryland law.
• Never drive or operate motor vehicles or heavy machinery while impaired by cannabis.
• Store all cannabis products securely, in child-resistant packaging, out of the reach of children and animals.
• Not provide cannabis products to any person under 21 years of age or to any person ineligible to receive them.
• Consume cannabis only in private settings; public consumption is prohibited under Maryland law.

10. User Accounts and Credential Security

Certain Site features may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete registration information.
• Keep your password secure and not share it with others.
• Notify us immediately at privacy@sol.md if you believe your account has been compromised or accessed without authorization.

SOL is not liable for any loss or damage arising from your failure to protect your account credentials.

11. Communications — Email and SMS Marketing

By providing your email address or mobile phone number and opting in, you consent to receive promotional and transactional communications from SOL. Where required by applicable law, we will obtain your express consent before sending marketing messages.

• Email: You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email or by contacting us at privacy@sol.md.
• SMS / Text messages: If you opt in to receive text messages, message and data rates may apply. Recurring automated marketing messages may be sent to the mobile number you provide. Reply STOP at any time to unsubscribe. Reply HELP for assistance.

Consent to receive marketing communications is not required as a condition of purchase.

12. User Submissions

If you submit questions, comments, or other content through the Site — including through Ask Dr. Dix or a general contact form — you represent that your submission is lawful and does not violate the rights of any third party. You further agree that:

• You will not submit confidential personal health or medical information through general-purpose Site forms. These forms are not secure medical record systems and are not protected by HIPAA.
• SOL may use your submission internally to improve its services and educational content, subject to our Privacy Policy.
• SOL does not guarantee a response to any submission and is not responsible for any reliance placed on unsolicited advice or information.

13. Intellectual Property

All content on the Site — including text, images, graphics, logos, trademarks, product names, educational materials, and the SOL Mood Match℠ tool — is the property of SOL of Montgomery LLC or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or otherwise exploit any Site content without our prior written permission. Nothing in these Terms grants you a license to use any SOL trademark, logo, service mark, or trade dress.

14. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the Site or its supporting infrastructure.
• Scrape, crawl, or systematically collect data from the Site without our prior written consent.
• Use the Site to purchase products for resale, redistribution, or any commercial purpose not authorized by SOL.
• Submit false, misleading, or fraudulent information, including false age or identity information.
• Interfere with or disrupt the integrity or performance of the Site.
• Engage in any conduct that could expose SOL to civil or criminal liability.

15. Third-Party Links

The Site may contain links to third-party websites and services, including Dutchie's ordering platform and brand partner pages. These links are provided for convenience only. SOL does not control, endorse, or assume responsibility for any third-party content, products, services, or privacy practices. Your use of any linked site is at your own risk and subject to that site's terms and policies.

16. Warranty Disclaimer

THE SITE AND ALL CONTENT, TOOLS, AND INFORMATION PROVIDED THROUGH IT ARE PROVIDED "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. SOL DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SITE IS AT YOUR OWN RISK.

17. Limitation of Liability

To the fullest extent permitted by Maryland law, SOL of Montgomery LLC, its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site or any products purchased through it, even if SOL has been advised of the possibility of such damages.

In no event shall SOL's total liability for any claim arising out of or related to these Terms or your use of the Site exceed the greater of the amount you paid to SOL for the specific transaction giving rise to the claim or one hundred dollars ($100). Some jurisdictions do not allow certain exclusions or limitations of liability, so the foregoing limitations may not apply to you to the full extent stated.

18. Indemnification

To the extent permitted by Maryland law, you agree to defend, indemnify, and hold harmless SOL of Montgomery LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party right.

19. Changes and Termination

SOL reserves the right to update or modify these Terms at any time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site after any revision constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.

SOL may suspend or terminate your access to the Site at any time, for any reason, with or without notice, including if we believe you have violated these Terms.

20. Governing Law and Venue

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict-of-law principles. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Montgomery County, Maryland, and you hereby consent to the personal jurisdiction and venue of such courts.

21. General Provisions

• Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
• No waiver: SOL's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Entire agreement: These Terms, together with our Privacy Policy and any additional terms applicable to specific features or services, constitute the entire agreement between you and SOL with respect to the Site and supersede all prior agreements and understandings.
